4. PROPERTY ADVERTISING

ACRE property advertisements and descriptions must be based on legitimate property characteristics and marketing considerations rather than protected characteristics.

Property marketing should not communicate unlawful preferences or exclusions.

This applies to:

  • Social media;
  • Meta advertising;
  • Search advertising;
  • Email;
  • SMS;
  • Video;
  • Print;
  • Signs;
  • Property brochures;
  • Agent marketing.

5. COMMUNITY AND NEIGHBORHOOD CONTENT

Neighborhood and community descriptions must be carefully prepared.

ACRE should not use demographic information, protected characteristics or coded language to suggest who “belongs” or does not belong in a particular neighborhood or property.

School, neighborhood and community information should be presented factually and should not be used to steer consumers toward or away from housing based on protected characteristics.

6. DIGITAL ADVERTISING AND AUTOMATED SYSTEMS

ACRE may use digital advertising platforms, machine-learning systems, analytics tools and automated delivery systems.

ACRE will take reasonable steps to configure and use these systems in a manner consistent with applicable fair-housing requirements.

Technology should not intentionally or unlawfully restrict housing advertising or services based on protected characteristics.

Where ACRE becomes aware of potentially discriminatory advertising behavior, the company should investigate and take appropriate corrective action.

7. PROPERTY SEARCH AND FILTERS

Property-search tools are intended to help users identify properties based on legitimate property characteristics and user preferences.

ACRE will not intentionally design property filters or search functionality to facilitate unlawful discrimination or steering.

8. AGENT RESPONSIBILITIES

ACRE agents and representatives are expected to:

  • Follow applicable fair-housing laws;
  • Treat consumers fairly;
  • Avoid discriminatory statements and conduct;
  • Avoid steering;
  • Avoid unlawful preferences or limitations;
  • Use compliant property descriptions;
  • Use compliant advertising;
  • Respond professionally to all inquiries;
  • Follow applicable accessibility and accommodation requirements.
