ACRE Realty is a real estate brokerage operating in accordance with applicable federal, state and local laws and regulations.

The Site may provide:

• Buyer and seller resources;

3. ELIGIBILITY AND LAWFUL USE

You may use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

• Violate any applicable law, regulation or rule;
• Submit false, misleading or fraudulent information;
• Impersonate another person or entity;
• Interfere with the Site’s operation or security;
• Attempt to access systems or data without authorization;
• Introduce malicious code, malware or harmful software;
• Use bots or automated systems to access the Site except as expressly authorized;
• Scrape, copy, harvest or systematically collect Site data without written authorization;
• Use listing information for a prohibited commercial purpose;
• Circumvent technical measures intended to limit access;
• Use the Site to discriminate, harass or engage in unlawful conduct.

4. PROPERTY LISTINGS AND PROPERTY INFORMATION

The Site may display property information from ACRE, ACRE agents, brokers, owners, MLS organizations, listing services, data providers, partners and other third parties.

• Bedrooms and bathrooms;
• Square footage;
• Lot size;

• Videos;
• Virtual tours;

The applicable source’s rights and restrictions may supersede general website functionality where required.

6. PROPERTY PHOTOGRAPHS AND MEDIA

Property photographs, floor plans, videos, virtual tours, graphics and other media may be supplied by agents, brokers, owners, MLS providers or third parties.

Such media may be subject to copyright or other intellectual-property rights.

Users may not download, reproduce, redistribute or commercially exploit property media without appropriate authorization.

7. PROPERTY DATA DISCLAIMER

Information on the Site is provided for general informational purposes.

ACRE does not guarantee:

• That a property remains available;
• That a listed price remains unchanged;
• That listing information is complete;
• That measurements are accurate;
• That photographs reflect current conditions;
• That descriptions contain every material fact;
• That estimated values represent appraisals;
• That market information predicts future outcomes.

Where ACRE provides an estimated property value, market estimate or similar tool, that information is an estimate only and is not an appraisal, valuation opinion or guarantee of sale price.

11. USER-SUBMITTED CONTENT

If the Site permits users, agents, brokers, clients or partners to submit content, including reviews, photographs, comments, descriptions or other materials, you are responsible for ensuring that you have the right to submit that content.

You represent that submitted content:

• Is truthful and not intentionally misleading;
• Does not infringe another person’s rights;
• Is not unlawful;
• Does not contain malicious code;
• Does not violate applicable rules or agreements.

Subject to applicable law and any separate agreement, you grant ACRE a non-exclusive right to host, reproduce, display and use submitted content for purposes reasonably related to operating, marketing and improving ACRE’s services.

12. REVIEWS AND TESTIMONIALS

ACRE does not knowingly create, purchase or publish fake consumer reviews or testimonials.

Reviews and testimonials presented by ACRE should represent genuine experiences and should not be presented in a misleading manner.

Where a testimonial involves a material relationship with ACRE, appropriate disclosure will be made where required.

13. INTELLECTUAL PROPERTY

The Site and its original content, including ACRE trademarks, logos, text, graphics, designs, software and other materials, are owned by or licensed to ACRE and are protected by applicable intellectual-property laws.

Except as permitted by law, you may not:

• Copy;
• Modify;
• Distribute;
• Republish;
• Sell;
• License;
• Create derivative works from;
• Publicly display or commercially exploit

ACRE-owned content without written authorization.

14. THIRD-PARTY SERVICES
